Terms of Service

Effective date: August 18, 2026

These terms govern your use of the Dealership mobile app and related services ("the Service"), operated by Disminal Innovations Inc of Ontario, Canada ("we", "us"). By creating an account or using the Service you agree to these terms. If you don't agree, don't use the Service — no hard feelings.

1. What the Service is

Dealership connects you with participating car dealerships. Through the app you can view vehicles and service history that a dealership associates with your phone number, book service appointments, browse dealership inventory, receive offers, and participate in a dealership's rewards program. The Service is a platform: the dealership — not us — performs your service, sells you vehicles, sets prices, and runs its rewards program.

2. Your account

• You sign in by verifying a phone number you control. You are responsible for using a number that is actually yours; verifying someone else's number to access their records is prohibited and likely illegal.
• You must be at least the age of majority in your province or territory (or have a guardian's consent) to book services.
• Keep your device secured. Anyone who can receive texts on your number and unlock your phone can act as you in the app.

3. Bookings and services

• An appointment booked in the app is a request to the dealership, confirmed per the dealership's own scheduling. The dealership may reschedule, decline, or cancel — the app will reflect what the dealership's systems say.
• Prices shown for service operations are the dealership's published starting prices and may vary with your vehicle's configuration and condition. The final invoice comes from the dealership.
• Missed appointments (no-shows) may affect how the dealership handles your future bookings, per that dealership's policies.

4. Inventory listings

Vehicle listings (including price, mileage, and availability) are imported from dealership systems and websites and can lag or contain errors. A listing is an invitation to enquire, not a binding offer. Confirm price and availability with the dealership before making any decision. Manufacturer names and model names identify the vehicles; their trademarks belong to their owners.

5. Rewards programs

• Points and rewards are issued and honoured by the individual dealership, under its program. Point values, earn rates, catalog items, and expiry are dealership decisions and may change.
• Points have no cash value, are not your property, and cannot be transferred, bartered, or sold. They are a loyalty benefit, not a currency.
• Referral and review bonuses require honest activity: real referrals of real people, and reviews reflecting your genuine experience. We and dealerships may reverse points obtained through fraud, gaming, or error, and may suspend accounts that farm them.
• If a dealership leaves the platform or ends its program, its points end with it, subject to applicable consumer-protection law.

6. Acceptable use

Don't misuse the Service. In particular, do not:

• access or attempt to access another person's records or another dealership's data;
• probe, scan, or test the vulnerability of the Service, or circumvent authentication;
• scrape, harvest, or bulk-export data from the Service;
• use the Service to send spam or unlawful communications, or to harass dealership staff;
• reverse-engineer the app except where law expressly permits it.

We may suspend or terminate accounts that break these rules, and we may cooperate with law enforcement where the law requires it.

7. Your content

Photos you add (for example, a photo of your car) remain yours. You grant us a licence to store and display them to you and your dealership inside the Service — that's the whole use. Don't upload content that is unlawful or that you don't have the right to share.

8. Notifications and messages

By verifying your number you consent to receive verification texts. Push notifications are separate, optional, and controlled by you in iOS Settings; the platform caps dealership marketing frequency. Message and data rates from your carrier may apply to texts.

9. Intellectual property

The Service — its software, design, and content we authored — is protected by law and belongs to us or our licensors. Dealership names, logos, and branding belong to the respective dealerships and are displayed with their authorization. These terms don't grant you rights beyond using the app as intended.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that records imported from dealership systems are complete or error-free, that listings are current, or that the Service will be uninterrupted. Nothing in the app is mechanical, safety, or financial advice — a service recommendation is your dealership's suggestion, not a certification of your vehicle's condition.

11. Limitation of liability

To the maximum extent permitted by law: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service; and our total liability for any claim relating to the Service is limited to CAD $100. We are not a party to, and are not liable for, the transactions between you and a dealership — the service work, vehicle sales, and rewards fulfilment are theirs. Some jurisdictions do not allow certain limitations; where a limitation is not allowed, it does not apply to you, and nothing in these terms overrides consumer rights that cannot be waived under the laws of your province, including Ontario's Consumer Protection Act.

12. Termination

You can stop using the Service and delete your account at any time (see the Privacy Policy for how). We may suspend or terminate the Service or your access to it for breach of these terms, legal necessity, or discontinuation of the platform, with notice where practicable.

13. Changes

We may update these terms. For significant changes we'll tell you in the app before they take effect; continuing to use the Service after that means you accept the updated terms. The current version always lives at this page.

14. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. Disputes are subject to the courts of Ontario, without limiting any mandatory consumer rights to proceed in your local jurisdiction.
